Por que não os Embargos Infringentes e de Nulidade para o Ministério Público?

Resumo
Se o legislador suprimir do Ministério Público, em sua luta pela Justiça, os instrumentos de batalha que concedeu ao infrator do ordenamento jurídico, estará repudiando, entre outros, o princípio da igualdade jurisdicional, insculpido no texto da Constituição Federal de 1988.Portanto, impõe-se a inserção de artigo no Código de Processo Penal que admita a oposição de embargos infringentes e de nulidade pelo Ministério Público sempre que este sofrer sucumbência por força de decisão não unânime do Tribunal.
Abstract
If the legislator suppresses from the Public Prosecution Service, in his or her fight for justice, the battle instruments that he or she granted to the infringer of the legal system, he or she will be repudiating, among others, the principle of jurisdictional equality, inscribed in the text of the Brazilian Federal Constitution of 1988. Therefore, it imposes -the insertion of an article in the Brazilian Penal Procedure Code that admits the opposition of infringing embargoes and nullity by the Public Prosecution Service whenever it suffers succumbency due to a non-unanimous decision of the Court.
