Resumo
A Lei nº 8.625, de 12.02.93 (LONMP), ao especificar as atribuições do Procurador-Geral de Justiça, alude àquela de dirimir conflitos de atribuições entre membros do Ministério Público, designando quem deva oficiar no feito(art. 10, X), porém, omite o poder de decisão a respeito da dúvida de atribuição. Seria por um esquecimento do legislador federal ou, ao contrário, seria esta uma lacuna desejada e cosciente? Na busca de uma resposta para tal indagação, tentaremos desenvolver o thema relacionado com a sobrevivência, ou não, da dúvida de atribuição em nosso direito positivo no âmbito do Parquet.
Abstract
Law nº 8,625, of 12.22.93 (Brazilian National Organic Law of the Public Prosecution Service), when specifying the powers of the Attorney General of Justice, alludes to that of settling conflicts of powers between members of the Public Prosecution Service, designating who should officiate in the deed (art. 10, X) however, it omits the power of decision regarding the attribution doubt. Was it due to a forgetfulness of the federal legislator or, on the contrary, was this a desired and conscious gap? In the search for an answer to this question, we will try to develop the theme related to the survival, or not, of the doubt about attribution in our positive right within the scope of the Public Prosecution Service.
