O crime de falsa identidade e a autodefesa

Resumo
Se a autoridade confunde o investigado com terceira pessoa, seja porque se enganou, seja porque o agente já vinha assumindo identidade falsa antes do cometimento do ilícito sob investigação, não está ele obrigado a revelar sua verdadeira qualificação, se a tanto não foi instado. Incide aqui, plenamente, a garantia nemo tenetur se detegere.
Abstract
If the authority confuses the investigated person with a third person, either because they were mistaken or because the agent had already assumed a false identity before the wrongdoing under investigation was committed, they are not obliged to reveal their true qualification if they were not so urged. It is fully here that the guarantee nemo tenetur se detecere.
