A regra geral em matéria de arquivamento de inquérito policial (ou de qualquer peça de informação) é a provisoriedade da medida, uma vez que, enquanto não extinta a punibilidade do fato, nos termos do verbete da Súmula 524 do STF, o feito poderá ser reaberto, desde que fato novo (aquele que importe na alteração substancial do que, antes, fora apurado) venha a ensejar a providência. Aliás, nos termos do art. 18 do CPP, a autoridade policial, mesmo depois de arquivado o inquérito policial, pode, caso tenha notícia de outras "provas", proceder a novas pesquisas, que poderão redundar no desarquivamento. A lei usou a expressão "outras provas" no sentido comum da palavra "prova", uma vez que na fase pré-processual há mera colheita de informações. Em duas situações, no entanto, o arquivamento torna-se definitivo; quando ele teve como arrimo a atipicidade do fato ou quando a providência reconheceu a extinção da punibilidade do fato.

The general rule regarding the filing of a police inquiry (or any piece of information) is the provisionality of the measure, since, while the punishment of the fact has not been extinguished, under the terms of the Brazilian Supreme Federal Court Precedent 524, the fact may be reopened, provided that a new fact (the one that implies a substantial alteration of what, before, was determined) comes to provide the measure. In fact, under the terms of article 18 ofthe Brazilian Code of Criminal Procedure, the police authority, even after the police investigation is closed, may, if it has news of other "evidence", carry out further research, which may result in the unarchiving. The law has used the expression "otherevidence" in the common sense of the word "proof" since in the pre-procedural phase there is a mere collection of information. In two situations, however, filing becomes final; when it had as support the atypicality of the fact, or when the providence recognized the extinction of the punishment of the fact.
